Mike Hadley Quoted in New York Times Article on 529 Account to Roth IRA Conversions

Davis & Harman Partner, Mike Hadley, was recently featured in a New York Times article titled, “Want to Move 529 Account Money to a Roth IRA? There’s a Hitch,” where he discussed whether the IRS intends to issue forthcoming guidance on whether the 15-year account ownership requirement resets if there is a beneficiary change for the account.
In the article, the New York Times details the ability for section 529 college savings account holders into a Roth IRA if certain conditions are met. One condition is that the 529 account must have been maintained for 15 years, however, the law is not clear whether a change in beneficiary would affect the 15-year timeline.
Mike Hadley is quoted saying that the IRS has made it clear that its priority is establishing regulations to implement the 2025 tax bill, known as the One Big Beautiful Bill Act. Hadley is quoted, “[t]he 529 issue is on their project list, but it’s really just a resource issue, I think.”
