Davis & Harman Partner, Kent Mason, was featured in a Plansponsor.com article titled, “Litigation Challenges Booming PRT Market, But Plan Sponsors Push Ahead,” where he discussed litigation challenging pension risk transfer deals and fiduciary standards under ERISA.

The Plansponsor.com article details growing litigation activity against plan sponsors challenging the fiduciary process employers used to select insurers to transfer pension obligations. The article notes that while litigation is on the rise, the pension risk transfer market is on a historic upswing with nine out of 10 plan sponsors surveyed expecting to transfer risk to an insurer within three years.

Mason is quoted saying:

“People are now looking at the cost of litigation as one of the administrative costs of doing these transactions. . . [t]here’s a decent chance you’ll get sued, but [plan sponsors] believe they’ll ultimately win.”
