Our approach is informed by our public service experience; our attorneys have served in senior roles for the Treasury Department, Internal Revenue Service, Senate Finance Committee, House Ways and Means Committee, and Joint Committee on Taxation. Within our areas of expertise, Davis & Harman’s team approach to legislative representation combines an in-depth knowledge of the tax law, ERISA, and the legislative process with a broad range of key relationships that our attorneys have established over the years.

We provide federal legislative services for most of our clients, including financial institutions, other large corporations (both public and private), trade associations, tax-exempt entities, and advocacy organizations. Our firm offers comprehensive legislative/lobbying services to our clients with a particular focus on tax, ERISA/benefits (including retirement and health), insurance, financial services, energy, housing, and commodities/agriculture issues. Since 1985, our attorneys have participated in every major regulatory and legislative effort affecting the federal tax law or ERISA, including especially the treatment of retirement plans, health plans, insurance products, and other savings vehicles.

In all areas, we assist clients in developing, advancing and responding to federal legislation. We monitor legislative developments and alert clients of proposals as they are developed by Members of Congress and within executive branch agencies. In performing these services, we seek to anticipate opportunities and threats of developments on each client’s products, business, and operations.

As appropriate, we also provide various advocacy services to clients on issues of particular importance to them, representing them before Congress and relevant executive branch agencies. With deep relationships on both sides of the aisle, we help clients exchange views with, and make their case before, Congressional offices and agency officials. We develop legislative and regulatory proposals that further client’s objectives and help revise existing or pending policy proposals to reflect our client’s interests. We initiate and lead coalitions that leverage the support of diverse stakeholders. As part of these efforts, our attorneys help vet and advance policy proposals with the relevant trade associations and interest groups and work to identify Members of Congress to champion proposals. We also assist with the development of advocacy materials, such as talking points, analyses of proposed or pending proposals, legislative specifications, and statutory language.
