Jason advises Davis & Harman clients on tax, ERISA, and other aspects of tax-favored retirement plans and executive compensation arrangements. He focuses primarily on traditional and hybrid defined benefit plans, 401(k) plans, 403(b) programs, 457 plans, IRAs, executive compensation arrangements and retiree health benefits. His clients are a diverse group—ranging from corporate employers, financial institutions and plan service providers to tax-exempt organizations and trade associations.
Jason is well-versed in the intricacies of representing clients before the Internal Revenue Service and the Department of Labor. He has handled ruling requests,
advisory opinions, prohibited transaction exemptions and controversy matters. He has also written numerous comment letters on regulatory matters, authored amicus curiae briefs on employee benefits matters in the federal courts of appeal, and testified on behalf of clients at hearings before the IRS and the Labor Department.
In addition, Jason is a sought-after speaker on a variety of employee benefits topics—from updates on pending retirement legislation to technical discussions on particular issues—and has appeared on PBS' Nightly Business Report, television's most watched evening business news program. Jason is widely quoted in the benefits trade press and is listed as a leading lawyer in The Legal 500 directory.
Jason is a co-author of the forthcoming edition of BNA’s Tax Management Portfolio on 401(k) plans. He has contributed chapters to several books—including the 403(b) Answer Book, 7th Ed. Supp. (Aspen Publishers), Annuities Answer Book, 4th Ed. (Aspen Publishers), and Complete Guide to Nonprofit Organizations, 1st Ed. (Civic Research Institute). He has also published articles on benefits matters in The Journal of Financial Service Professionals, The Journal of Investment Consulting, and other periodicals.
Prior to joining Davis & Harman, Jason was a member of the Washington, DC tax firm of Caplin and Drysdale, Chartered. Before that, he was a law clerk to a federal appellate judge. He holds a BA from Hamilton College and a JD from Cornell Law School, where he was a member of the Order of the Coif and an editor of the Cornell Law Review. He is a member of the District of Columbia and New York bars.
